Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Prefetch API, dashboard, and related services (collectively, the "Service"). By creating an account or making an API request, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Prefetch provides a Brand Data API that extracts structured data from publicly accessible URLs — including brand colors, logos, fonts, website screenshots, company information, industry classification, and employee/founding data. The API is accessed programmatically via HTTP requests authenticated with an API key issued to your account.
2. Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.
You are responsible for maintaining the confidentiality of your API key and account credentials. Any activity performed with your API key is your responsibility. If you suspect unauthorized use, notify us immediately at hi@prefetch.io.
You must be at least 13 years old to create an account. Accounts registered on behalf of a business entity represent that the individual has authority to bind that entity to these Terms.
3. API Credits & Plans
Access to the API is denominated in credits. Each endpoint consumes a defined number of credits per successful request:
- Website Screenshots — 2 credits per URL
- Website Classification — 5 credits per URL
- Company Data — 5 credits per URL
- Brand Data Extraction — 10 credits per URL
- Full Enrichment (All-in-One) — 20 credits per URL
The Free plan includes 500 credits with no credit card required. The Standard plan includes 50,000 credits per month at the published rate ($39/month billed annually or $47/month billed monthly). Additional credits beyond the monthly allowance are billed at $19 per 10,000 credits.
Credits reset at the start of each billing cycle. Unused credits do not roll over. Credits are non-refundable once consumed.
4. Billing & Payments
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access and credits until then. We do not provide partial refunds for unused time, except where required by applicable law.
If a payment fails, we may suspend your access until payment is resolved. We will attempt to notify you by email before suspension.
Prices may change with 30 days' notice. Notice will be provided via email to your registered address.
5. Acceptable Use
The Service is designed for legitimate use cases such as: building brand-aware applications, enriching CRM data, powering design tools, competitive research, and lead enrichment. You agree to use the Service only for lawful purposes.
You must not use the Service to:
- Scrape or process URLs in violation of those websites' Terms of Service or applicable law.
- Build databases of personal data derived from scraped sources without proper legal basis.
- Circumvent rate limits, abuse free tier access, or share API keys across multiple accounts.
- Attempt to reverse-engineer, probe, or attack Prefetch infrastructure.
- Resell raw API access or build a competing brand data API service on top of our infrastructure without an enterprise agreement.
- Use the Service for any unlawful purpose, including GDPR violations when processing data about EU residents.
Violation of this section may result in immediate termination of your account without refund.
6. Rate Limits
The Standard plan is subject to a rate limit of 60 requests per minute and 1 concurrent request. Enterprise plans have custom limits. We reserve the right to throttle or suspend accounts that exceed rate limits or place unusual load on the infrastructure. If you need higher throughput, contact us about an Enterprise plan.
7. Data Processed via the API
You retain ownership of the URLs you submit and the structured data returned to you. You grant us a limited license to process those URLs solely to deliver the API response.
We may cache API results briefly (up to 24 hours) to improve performance and reduce redundant computation. We do not sell or share the results of your queries with third parties.
You are responsible for ensuring your use of the API — and what you do with the data returned — complies with all applicable laws, including privacy and data protection regulations.
8. Intellectual Property
The Prefetch name, logo, API design, dashboard interface, and documentation are our intellectual property. These Terms do not grant you any right to use our trademarks, trade names, or branding except as needed to accurately describe your use of the API (e.g. "Powered by Prefetch").
If you provide feedback or suggestions about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve our products.
9. Disclaimers & Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The API will be uninterrupted, error-free, or available at any specific time.
- The data returned (colors, logos, company info, etc.) is 100% accurate or complete — results depend on the content of the target URL at the time of the request.
- The Service will meet your specific requirements.
We target 99.9% uptime and publish API status at the footer of our site, but this is not a contractual SLA unless you hold an Enterprise agreement with explicit SLA terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Prefetch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim.
11. Termination
You may close your account at any time via account settings or by emailing us. Upon closure, your API key is immediately revoked.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or any reason that poses a risk to the Service or other users. Where practical, we will provide notice before termination. In the case of serious violations (e.g. abuse, illegal activity), termination may be immediate without notice or refund.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which Prefetch operates, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through the competent courts of that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should cancel your subscription before they take effect.
